Trafficking, or otherwise illegally selling or distributing, prescription drugs is unlawful in Arizona. While prescription drugs themselves are legal, it is illegal to possess or use them unless they were obtained through a prescription from a valid provider. This alone is a class 1 misdemeanor and can result in six months of incarceration.

A.R.S. 13-3406 lays out the laws regarding the trafficking of prescription drugs in the state. Regarding this issue, the statute states that a person may not knowingly:

  • Transport, import into Arizona, offer to transport, or offer to import into Arizona, transfer, offer to sell, or offer to transfer a prescription-only drug.
  • Sell or distribute a misbranded drug.

Selling or distributing a misbranded drug is a class 4 felony, for which a first-time offender can be incarcerated for up to 3.75 years.

The remaining prescription drug trafficking violations are class 6 felonies, for which a first-time offender can be incarcerated for up to 2 years. Additionally, if granted probation, the court can order the defendant to perform at least 240 hours of community restitution.

In all cases, a convicted person will be court-ordered to pay a fine of $1000.
